Nectarkast LLC, ("us", "we", "our", or “necktarkast”) operates the nectarkast.com website and the nectarkast mobile beacon application (the "Service").

We recognize that your privacy is very important and take it seriously. This Privacy Policy describes Nectarkast’s policies and procedures on the collection, use, disclosure, and sharing of your information when you use the Nectarkast Service, via the Nectarkast website, Nectarkast content embedded on another site (such as a Nectarkast “Follow” button), your mobile phone, or through one of Nectarkast’s applications for mobile devices (e.g., the Nectarkast beacon application).

We will not use or share your information with anyone except as described in this Privacy Policy.

We use your Personal Information for providing and improving the Service. By using the Service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms and Conditions.

This Privacy Policy does not apply to information we collect by other means (including offline) or from other sources.

Information Collection and Use

While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to, your email address, name, phone number, postal address ("Personal Information").

We collect this information for the purpose of providing the Service, identifying and communicating with you, responding to your requests/inquiries, servicing your purchase orders, improving our services, maintain security, personalize content, remember information to help you efficiently access your account, monitor aggregate metrics such as total number of visitors, traffic, and demographic patterns, and track User Content and users as necessary to comply with the Digital Millennium Copyright Act and other applicable laws.

User-Provided Information:

You provide us information about yourself, such as your name, e-mail address and interests, if you register for a member account with the Service. Your name and other information you choose to add to your profile will be available for public viewing on the Service. You may provide us with your mobile phone number if you choose to submit questions and receive answers via text message. We may use your email address to send you Service-related notices (including any notices required by law, in lieu of communication by postal mail). You can control receipt of certain Service-related messages on your Settings page. We may also use your contact information to send you marketing email messages. If you do not want to receive such messages, you may opt out by following the instructions in the message. If you correspond with us by email, we may retain the content of your email messages, your email address and our responses.

If you use your Facebook, Twitter, or other social networking site (“SNS”) account information to sign in to Nectarkast, we will collect and store your SNS user ID. If you connect your Nectarkast account with your SNS account (such as to enable posting from Nectarkast, we ask for your permission to collect certain information from your SNS account (such as information from your SNS profile).

You also provide us information in User Content you post to the Service. Your questions, answers, and other contributions on the Service, and metadata about them (such as when you posted them), are publicly viewable on the Service, along with your name (unless the Service permits you to post anonymously). This information may be searched by search engines and be republished elsewhere on the Web in accordance with our Terms of Service.

In addition, we may use third party services such as Google Analytics that collect, monitor and analyze this type of information in order to increase our Service's functionality. These third party service providers have their own privacy policies addressing how they use such information.

We may also collect information that your browser sends whenever you visit our Service or when you access the Service by or through a mobile device ("Log Data").

This Log Data may include information such as your computer's Internet Protocol ("IP") address, browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages and other statistics.

When you access the Service by or through a mobile device, this Log Data may include information such as the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use and other statistics.

If you choose to use our invitation service to invite a friend to the Service, we will ask you for that person’s email address and automatically send an email invitation. You may also use our contact importer tool to help you upload your friends’ email addresses so you can find friends who are already on Nectarkast or invite friends to the Service. Nectarkast stores this information to send invitations, to register your friend if your invitation is accepted, to track the success of our invitation service, and to identify your friends on Nectarkast. By providing your friends’ email addresses to Nectarkast, you warrant that you have their consent to do so and for Nectarkast to use this information as described above.

Location Information

We may use and store information about your location depending on the permissions you have set on your device. We use this information to provide features of our Service, to improve and customize our Service. You can enable or disable location services when you use our Service at any time, through your mobile device settings.

Information Collected Automatically

When you use the Service, we use persistent and session cookies (for information on cookies, please see below) and other tracking technologies such as log files, clear GIFs, and Flash technologies to: (a) store your username and password; (b) analyze the usage of the Service; (c) customize the Service to your preferences; and (d) control the advertising displayed by the Service. We also may include clear GIFs in HTML-based emails sent to our users to determine whether the message has been opened. As we adopt additional technology, we may also gather additional information through other methods.

We use these automated technologies to collect and analyze certain types of information, including: (a) information related to the devices or browsers you use to access or interact with the Service, such as: IP addresses, geolocation information, unique device identifiers and other information about your mobile phone or other mobile device(s), browser types, browser language, and unique numbers or codes in cookies; and (b) information related to the ways in which you interact with the Service, such as: referring and exit pages and URLs, platform type, the number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time you used the Service, and other similar information. Nectarkast discloses a subset of this automatically collected information publicly. Specifically, you consent to Nectarkast’s disclosure of information related to the ways in which you interact with the Service, such as: landing pages, pages viewed and the order of those pages (including questions and answers viewed), the date and time you used the Service, and other similar information on the Service to other Nectarkast users, along with your name and profile picture. If you do not wish to have this information disclosed to the public, you may opt out of this feature by visiting settings.

We may collect different types of information about your location, including general information (e.g., IP address, zip code) and more specific information (e.g., GPS-based functionality on mobile devices used to access the Service), and may use that information to customize the Service with location-based information and features. If you access the Service through a mobile device and you do not want your device to provide us with location-tracking information, you can disable the GPS or other location-tracking functions on your device, provided your device allows you to do this.

Cookies

A cookie is a small text file stored by a website in a user’s web browser (e.g. Internet Explorer, Safari, Firefox or Chrome) that helps us in many ways to make your visit to our website more enjoyable and meaningful to you. Among other things, cookies avoid you having to log in every time you come back to our website. Product features and setting cookies. We use these cookies to enable the functionality of some features within the Nectarkast product, in particular to personalize the experience towards you. We also use these cookies to store certain of your preferences and settings.

Advertising cookies. We use these cookies to help deliver relevant ads to you and measure the performance of ads.

Flash Cookies. We may, in certain situations, use Adobe Flash Player to deliver special content, such as video clips or animation. Nectarkast may allow third parties to help us collect and analyze information about your use of the service, generate aggregate site usage statistics and provide content sharing services to support the Service. Nectarkast does not control the third parties’ use of such technologies and their use is governed by those parties’ privacy policies.

Nectarkast may also allow third-party ad servers or ad networks to serve advertisements on the Service and on third-party services. These third-party ad servers or ad networks use technology to send, directly to your browser, the advertisements and links that appear on Nectarkast. They automatically receive your IP address when this happens. They may also use other technologies (such as cookies, JavaScript, or web beacons) to measure the effectiveness of their advertisements and to personalize the advertising content. Nectarkast does not provide any information that can identify you personally to these third-party ad servers or ad networks without your consent. However, please note that if an advertiser asks Nectarkast to show an advertisement to a certain audience and you respond to that advertisement, the advertiser or ad server may conclude that you fit the description of the audience they are trying to reach.

Do Not Track Disclosure

Nectarkast itself does not respond to “do not track” signals, and we do not control whether third parties do. Communications

We may use your Personal Information to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. We will disclose your Personal Information where required to do so by law or subpoena or if we believe that such action is necessary to comply with the law and the reasonable requests of law enforcement or to protect the security or integrity of our Service.

We may also share your information with third parties offering combined services with Nectarkast. For example, we may share your information with third-party partners that display Nectarkast questions and answers through their services so that such partners can tailor content and advertising to you. If we do this, such third parties’ use of your information will be bound by this Privacy Policy.

As we develop our business, we may buy or sell assets or business offerings. Customer, email, and visitor information are generally among the transferred business assets in these types of transactions. We may also transfer or assign such information in the course of corporate divestitures, mergers, or dissolution.

Nectarkast uses a variety of physical, managerial, and technical safeguards to preserve the integrity and security of your information, based on the sensitivity of the information. We cannot, however, ensure or warrant the security of any information you transmit to Nectarkast or guarantee that your information on the Service may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

International Transfer

Your information, including Personal Information, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.

If you are located outside United States and choose to provide information to us, please note that we transfer the information, including Personal Information, to United States and process it there.

Children's Privacy

Protecting the privacy of young children is especially important. We do not knowingly collect personally identifiable information from children under 13. You may, of course, decline to submit information through the Service, in which case Nectarkast may not be able to provide certain services to you. You may update or correct your account information and email preferences at any time by logging in to your account. You may also delete your account if you chose to.

Your California Privacy Rights

California law permits users who are California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed their personal information (if any) for their direct marketing purposes in the prior calendar year, as well as the types of personal information disclosed to those parties. Changes to This Privacy Policy

This Privacy Policy is effective as of September 13, 2017 and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page.
